What Is Divorce Mediation?

Mediation is the process of working out the legal and logistical problems that inevitably arise during your case with a trained, neutral third party.
The goal of mediation is to avoid dragging the battle into the courtroom. It will save both parties a large chunk of cash if mediation is successful and everyone walks away more or less happy. The alternative involves months of legal battles with thousands of dollars going into the pockets of the attorneys instead of staying with you and your soon-to-be former spouse.

Mediation is non-binding, which means that if you’re unhappy with the results, you can always go to court.

The biggest advantage outside of saving money and avoiding protracted and emotional courtroom battles is that you get to set the terms for the dissolution of the marriage. This means that you can essentially opt out of the courts rules by coming to your own agreements.
You can add terms to your parenting plan that a judge would never order. You can design spousal maintenance and retirement plans around your unique circumstances and not the laws of Arizona.
Mediation is a much shorter process than going to court and the process is confidential. A good mediator can help both parties understand the strengths and weaknesses of their case and help move the case toward settlement. Typically, we tackle each issue individually. Any issues we take “off the table” will make a difference in the overall cost and tone of your case.
The decision to end a marriage can be extremely difficult. Working through the details of a divorce takes time, patience, and an understanding attorney who can help both parties.
